TO ENTER: There are two (2) ways to enter: (1) enter online by visiting www.modernluxury.com/travelplanner, completing all of the required information, following all instructions, and submitting your entry by clicking on the "Send Information" button; or (2) enter by mail by printing your name, address, e-mail address (optional), daytime telephone number (optional) and the name of the prize drawing ("Modern Luxury Travel Planner Sweepstakes") on a 3½” x 5” card and mailing it to: Modern Luxury Travel Planner Sweepstakes, 5455 Wilshire Blvd., Ste. 1412, Los Angeles, CA 90036. The entry period will begin at 12:01 A.M. (ET) on March 28, 2008 and will close at 11:59 P.M. (ET) on October 31, 2008. Mail-in entries must be postmarked by October 31, 2008 and Internet entries must be received by 11:59 P.M. (ET) on October 31, 2008.
ENTRY DETAILS: Eligible entrants must enter via either the mail-in or online methods described. Limit one entry per person. Multiple entries submitted by a single person, whether via mail-in or Internet, are void. Incomplete entries are void. By entering or accepting a prize, entrants and travel companion agree to be bound by and comply with the decisions of Modern Luxury Media, LLC and these Official Rules, including all eligibility requirements, and agree to comply with applicable law. No mechanically reproduced, software-generated or other automated multiple entries permitted. Modern Luxury Media, LLC will not be responsible for incomplete, lost, late, misdirected or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Modern Luxury Media, LLC, or for any human error, lost/delayed data transmission or any other error or malfunction. In the event of a dispute, all e-mail entries will be deemed to have been submitted by the owner of the e-mail account from which they were sent. For these purposes, an e-mail account holder shall mean the natural person assigned to such e-mail account by the Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. All entries become the property of Modern Luxury Media, LLC and will not be acknowledged or returned. You agree that you shall not upload, post or transmit any materials which contain any computer viruses, Easter eggs, worms, Trojan Horses or other harmful component or programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. Entry materials that have been tampered with or that are altered are void. Any questions regarding the number of entries submitted or the owner of an e-mail account shall be determined by Modern Luxury Media, LLC in its sole discretion, and Modern Luxury Media, LLC reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Sweepstakes.
ELIGIBILITY: Sweepstakes is open only to legal residents of the fifty states in the United States and the District of Columbia, who are 21 years of age or older at time of entry. Sweepstakes is not open to officers, directors, representatives, agents, and employees of Modern Luxury Media, LLC and its affiliates, subsidiaries, and agencies, and their immediate family members (defined as parent, spouse, child, or sibling, and their respective spouses) and those living in the same households of any of such individuals. This Sweepstakes is subject to all applicable federal, state and local laws of the United States, and all controversies or disputes arising out of or relating to this Sweepstakes shall be resolved exclusively in the state and federal courts located in Los Angles, California, and in the courts of appellate jurisdiction therefrom, and entrants and travel companion waive any defenses based on venue or forum non conveniens. All travel and use of the prizes will be at winner’s and travel companion’s risk. Winner and travel companion agree to release and hold harmless Modern Luxury Media, LLC and its affiliates, subsidiaries, and agencies, and those working for or on behalf of any of them, from any damage, injury, loss, damage, or liability of any kind arising or resulting from participating in this Sweepstakes or the awarding, acceptance, use, or misuse of any prize. Void where prohibited.
PRIZES: One (1) grand prize winner will be selected in a random drawing, conducted by Modern Luxury Media, LLC, from among all eligible entries received, to be held on or about November 7, 2008. One (1) grand prize winner will receive a two (2) consecutive night stay (one room for up to two people) at the Hotel Vitale in San Francisco (approx. retail value: $800) and dinner for two (excluding alcoholic beverages) at the Americano Restaurant and Bar (approx. retail value: $300). Prizes must be used no later than December 31, 2009. Odds of winning depend on the number of eligible entries received. All prizes will be awarded.
WINNER NOTIFICATION AND ACCEPTANCE: Potential winner will be notified by e-mail or mail on or about November 14, 2008. Return of prize notification as undeliverable may result in disqualification and an alternate winner may be selected. Winner may waive his or her right to receive a prize. Prizes are nontransferable, nonassignable, and non-endorsable, and no cash or other substitutions will be offered, except at the sole discretion of Modern Luxury Media, LLC. Modern Luxury Media, LLC has the right to substitute a prize of equal or greater value. Prizes and individual components of prize packages are subject to availability. Hotel prize includes room rate and related taxes only. Winner and travel companion are responsible for all expenses not expressly included, such as additional food and beverage, airline and ground transportation, insurance, gratuities, activities, and other incidental costs. Hotel and restaurant reservations are subject to availability, and blackout dates may apply. Once hotel and restaurant reservations are made, they may not be changed, except at Modern Luxury Media, LLC’s sole discretion. Modern Luxury Media, LLC is not responsible for winner’s or travel companion’s inability to accept or use a prize. Winner and travel companion agree to comply with all requirements and restrictions of any prize providers. Winner is solely responsible for reporting and payment of any taxes on prizes. Travel companion must be at least 21 years of age. Winner and travel companion may be required to complete an affidavit of eligibility and a liability and publicity release (except where prohibited by law), which must be returned within 14 days of the date of notification. Failure to sign and return any required documentation within 14 days, or to comply with any term or condition of these Official Rules or other instructions from Modern Luxury Media, LLC, may, at the sole discretion of Modern Luxury Media, LLC, result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate winner. You are not a winner until your submissions are validated. Except where prohibited, participation in the Sweepstakes or acceptance of a prize constitutes entrant’s and travel companion’s consent to the use of his or her name, picture, likeness, address (city and state), and biographical information, in any manner, in any all media (whether now or hereafter known), anywhere in the world, in perpetuity, for any advertising, commercial, or promotional purposes, without limitation or further compensation. PRIVACY: By entering this Sweepstakes, entrants agree that (notwithstanding anything to the contrary contained in any Modern Luxury Media, LLC privacy policy) any information that entrants share with Modern Luxury Media, LLC (including, without limitation, all information included on any entry form) may be (a) used (and disclosed to third parties) by Modern Luxury Media, LLC for purposes of administration of the Sweepstakes, to market products and services to entrants, and for other purposes as Modern Luxury Media, LLC shall determine in its sole discretion and (b) disclosed to Modern Luxury Media, LLC’s advertisers for them to use and disclose as they shall determine in their sole discretion.
